Terms of Use & Service Level Agreement

These Terms of Use and Service Level Agreement apply to the use of AdPage.io's Services, a trade name of AdPage B.V. (Chamber of Commerce 75440482), with registered office at Velmolenweg 54 A, 5404 LD Uden, the Netherlands (“AdPage”, “we”, “us”, “our”). These terms of use supplement the General Terms and Conditions, the Processor Agreement and — for the Data Assistant — the Data Assistant Terms. In case of conflict, the most specific provision shall prevail.

1. Services

The services include, but are not limited to:

  • Hosting: hosting of the Google Tag Manager (“GTM”) server container.
  • Features: the features offered and the description per platform as defined on www.adpage.io/pricing.
  • Implementation Service: During onboarding, agreements are made concerning features and platforms and further specified in a tagging plan. Anything not indicated during onboarding, including the tagging plan and desired advertising platforms, falls outside the scope of the service.
  • Customer support: email support (support@adpage.io), see section 2.
  • Tracking Dashboard: A dashboard for tracking the account and its used features.
  • AdPage Data Assistant: AI-powered analytics, Multi-Touch Attribution, Marketing Mix Modeling, benchmarking and the AdPage MCP server, subject to the Data Assistant Terms.
  • Knowledge base: access to a knowledge base with explanations of the features.
  • Subscription types: the scope of Services provided is available on the website on pages dedicated to subscriptions or products, or offered separately, such as a multi-trip ticket at www.adpage.io/strippenkaart. AdPage reserves the right to change the content and price of a subscription or product; in this case, the change will apply from the next billing period.

Disclaimer: The Services do not constitute business, technical, legal, or any other professional advice. AdPage is not liable for the results of your use of the Services, including, but not limited to, Model Output and Benchmark Data from the AdPage Data Assistant.

2. Support

AdPage offers support via a knowledge base and for incidents via customer support at support@adpage.io.

Reporting Procedure: AdPage processes reports from the Customer and/or User and aims to record them accurately with classification, time and date stamp, and assigned priority. A report that has been resolved to satisfaction will be recorded. If AdPage requires additional information from the Customer, it will request it as quickly as possible and send a reminder if necessary.

Availability: Customer support is available during office hours from 09:00 to 17:00. Notifications received outside of office hours will be handled during office hours.

Reporting: AdPage correctly captures service results in an insightful and accessible manner, including the number of notifications, nature and priority of incidents, response times, and total measured availability.

Exceptions to availability: force majeure (including government intervention, internet failures, sabotage by third parties) and pre-announced work are not included in the availability.

3. Service Levels and Availability

AdPage adheres to the following service levels:

  • Uptime: monthly uptime of 99.81% for the main servers and the functionality of the Google Tag Manager server container. Uptime is measured monthly and can be viewed in the tracking dashboard.
  • Incident response times, measured from receipt via support@adpage.io to an initial response or status update:
  • High priority (Service not available): response within 4 hours during office hours.
  • Normal priority (functionality not working correctly): response within 1 working day during office hours.
  • Low priority (question or advice): response within 2 working days during office hours.

4. Roles and responsibilities

AdPage Responsibilities

  • Proactively monitoring infrastructure and services.
  • Timely communication of planned maintenance and unforeseen disruptions.
  • Processing notifications and resolving incidents within the set response times.

Customer Responsibilities

  • Report incidents promptly via support@adpage.io.
  • Providing all the necessary information to investigate and resolve a report.
  • Ensuring a stable internet connection and keeping own systems up-to-date.
  • The correct implementation of consent management and the passing of consent signals to the Services.

5. Permitted Use

The Customer and its users shall use the Services solely for their intended purposes, in accordance with the Agreement, these Terms of Use, and all applicable laws and regulations.

6. Prohibited use

It is not permitted to:

  • to use the Services in a manner that is contrary to the law or the rights of third parties;
  • to circumvent security or access measures or to disrupt the operation of the Services;
  • to reverse engineer, decompile or disassemble, except to the extent that such acts are permitted by mandatory law;
  • transferring end-user personal data to the Services without a valid legal basis and correct consent registration;
  • Using or presenting model outputs, attribute values, or benchmark data in contravention of the Data Assistant Terms, or presenting them as definitive facts where they are statistical estimates.

7. Account and access

Access to the Services requires an account. The Customer shall handle login details with care and is responsible for all actions performed under an account. Loss or misuse must be reported immediately to support@adpage.io. AdPage advises strong passwords and, where available, two-factor authentication.

8. Incident and Problem Management

Classification of incidents: incidents are classified based on impact and urgency. This classification determines priority and response time.

Resolution times: Following the initial response, AdPage aims to resolve high-priority incidents within 24 hours during business hours. For normal priority, the target is 3 working days, and for low priority, it is 5 working days. These times may vary if third-party dependencies are involved.

Change management

AdPage may change the content and price of subscriptions and products. Changes to the services that affect the service levels set out in this SLA will be communicated in writing at least 30 days in advance.

10. Escalation procedure

If you are dissatisfied with the progress or the solution offered, the report can be escalated to the Customer Support Manager via support@adpage.io.

11. Schorsing

AdPage kan de toegang tot de Diensten geheel of gedeeltelijk schorsen indien (i) Klant in strijd handelt met deze Terms of Use of de Overeenkomst, (ii) gerechtvaardigde verdenking bestaat van misbruik of veiligheidsrisico, of (iii) een wettelijke verplichting dit vereist. AdPage informeert Klant zo spoedig mogelijk over de schorsing en de reden.

12. Logging en audit

AdPage kan loggegevens vastleggen ten behoeve van beveiliging, foutdetectie, capaciteitsbeheer en handhaving van deze Terms of Use. Loggegevens worden bewaard conform het Privacy- en Cookiebeleid AdPage Producten (algemene audit logs maximaal 12 maanden, MCP- en Apps SDK-audit logs maximaal 90 dagen).

13. Contractduur en opzegging

Deze Terms of Use en SLA zijn onlosmakelijk verbonden met de hoofdovereenkomst en hebben dezelfde looptijd. Bij beeindiging van de hoofdovereenkomst vervallen ook deze Terms of Use en SLA. Voorwaarden voor opzegging staan beschreven in de Algemene Voorwaarden.
